Terms and Conditions of Service

1. About the Service Provider

The Service valuation.plus372.ee (the "Service") is provided by WELDME OÜ, a company registered in the Republic of Estonia and operating under the trading name “Estiq”.

2. Scope of the Service

The Service provides automated, statistical property value estimates (“Valuations”) based on mathematical models, open datasets, H3 indices, comparable sales, and user-provided information.

The Service includes:

  • Automated valuation reports;
  • Market analytics and visualisations;
  • Optional paid digital reports (PDF).

The Service does not include certified appraisals, brokerage services, legal/financial advice, or outputs compliant with IVS or mortgage standards.

3. Acceptance of the Terms

3.1. Agreement: By accessing or using the Service, you agree to these Terms.

3.2. Eligibility: You must be at least 18 years old and legally capable of entering into a binding agreement.

3.3. B2C and B2B: These Terms apply to both Consumers and Business Customers, except where specifically stated otherwise.

4. Important Disclaimers

The Valuation is automatically generated and provided for informational purposes only.

Not a Professional Appraisal: The Valuation is not a certified appraisal, survey, or financial recommendation. It is not recognised by banks and does not comply with International Valuation Standards (IVS).

No Accuracy Guarantee: We do not warrant the completeness, correctness, or reliability of datasets or mathematical models, including H3 indices and comparable sales data.

User Responsibility: You are solely responsible for decisions made using the Valuation. You should consult a qualified real estate professional before making financial or legal decisions.

5. User Obligations

You agree to:

  • Use the Service only for lawful purposes;
  • Provide accurate and truthful property information;
  • Not misuse the Service, including scraping, crawling, reverse engineering, or introducing malware;
  • Not commercially resell or redistribute the Service without written permission.

6. License to Submitted Data

When submitting non-personal property data (e.g., size, condition), you grant WELDME OÜ a non-exclusive, worldwide, royalty-free license to use such data solely for:

  • Generating Valuations;
  • Improving statistical models;
  • Producing anonymised or aggregated analytics.

Personal data is processed strictly under GDPR and is not subject to this license.

7. Intellectual Property

All algorithms, models, designs, interfaces, and trademarks are the exclusive property of WELDME OÜ or its licensors. You receive a limited, non-transferable license to use the Service for private informational purposes.

8. Consumer Withdrawal Rights (Digital Content)

If you are an EU Consumer purchasing digital content (e.g., paid PDF reports):

By requesting immediate access to the digital content, you agree that:
- Delivery of the content begins immediately; and
- You lose your statutory right of withdrawal once access or download begins.

This is in accordance with Article 53(4) of the Estonian Law of Obligations Act and Article 16(m) of the EU Consumer Rights Directive.

9. Service Availability

We strive for uninterrupted Service but do not guarantee continuous, error-free operation. We may suspend or modify the Service for maintenance, security, or technical reasons.

10. Automated Decision-Making Notice (GDPR Art. 22)

The Valuation is generated using automated processing. You have the right to:

  • Request human review;
  • Contest automated outputs;
  • Request an explanation of the logic involved.

11. Liability

11.1 Consumers (EU)

Nothing in these Terms limits your statutory rights under Directive (EU) 2019/770 or Estonian law.

We are not liable for:

  • Loss of profit or expected savings;
  • Investment decisions based solely on the Valuation;
  • Inaccuracies caused by incorrect or incomplete user input.
11.2 Business Customers
  • The Service is provided “AS IS.”
  • No implied warranties apply.
  • We are not liable for indirect, incidental, or consequential losses.
  • Maximum liability in any 12-month period is limited to the amount paid for the Service.

12. Data Protection (GDPR)

We process personal data in accordance with the GDPR and Estonian data protection law. Please review our Privacy Policy for information regarding your rights and our processing practices.

13. Third-Party Links

The Service may include links to third-party websites. We are not responsible for their content, practices, or data handling policies.

14. Termination

We may suspend or terminate your access if you breach these Terms, misuse the Service, or create technical/security risks.

15. Governing Law & Dispute Resolution

The Terms are governed by the laws of the Republic of Estonia.

  • Consumers: You may bring disputes before your local EU court. This clause does not affect your statutory rights.

  • ODR Platform: ec.europa.eu/consumers/odr
  • Business Customers: All disputes shall be settled exclusively by the Harju County Court (Harju Maakohus).

16. Changes to These Terms

We may update these Terms to reflect legal, technical, or operational changes. Continued use after the effective date constitutes acceptance. Material changes will be announced in advance when required.
